Terms of Service

Last updated: October 5, 2026

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the CloudGallery website, application, and related services (the "Service"). By accessing or using the Service, you agree that you have read and understood these Terms and are legally bound by them. If you do not agree, you may not access or use the Service.

2. Service Description

CloudGallery is a SaaS workflow management platform for artists and galleries. The Service provides artwork inventory management, AI-powered image analysis and enhancement, exhibition management, contact management (CRM), and related productivity tools. CloudGallery is operated by Enable Inc. (주식회사 이네이블), business registration number 377-86-04287.

3. NOT a Sales Intermediary

CloudGallery is a software-as-a-service workflow tool. CloudGallery does NOT operate as a marketplace, intermediary, broker, escrow agent, or payment processor for the sale of artwork or any other goods. The Service does not facilitate, process, or intermediate sales transactions between users, or between users and third parties. Any transactions related to artwork sales, commissions, consignments, or gallery-artist arrangements are conducted entirely outside the platform and are the sole responsibility of the parties involved. CloudGallery is not a party to such transactions and bears no responsibility or liability for them. E-commerce consumer protection provisions regarding intermediary obligations do not apply to CloudGallery because the Service does not intermediate sales.

4. Membership and Accounts

4.1 Registration. You may register for an account by providing your email address and creating a password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. 4.2 Account Types. Accounts are created under a plan-based workspace (Artist, Gallery Basic, or Gallery Pro). Roles within each workspace include owner, admin, artist, staff, and viewer, each with different access levels. 4.3 Accurate Information. You agree to provide accurate and complete information during registration and to keep your information updated.

5. Trial Service

5.1 Free Trial. New accounts receive a one-month free trial with access to all features. No credit card is required during the trial period. 5.2 Trial Expiration. Upon expiration of the trial period, account access is suspended. We will notify you before your trial expires. To continue using the Service, you must subscribe to a paid plan. 5.3 Trial Modifications. We reserve the right to modify trial duration, features, and terms at any time.

6. Subscription and Payment

6.1 Subscription Tiers. We offer the following paid subscription tiers: Artist (₩29,000/month), Gallery Basic (₩99,000/month), and Gallery Pro (₩199,000/month). All prices include VAT. 6.2 Payment Processing. Payments are processed through a licensed payment gateway. By subscribing, you authorize recurring monthly billing through the selected payment method. Your payment information is handled securely by the payment gateway and is not stored on our servers. 6.3 Auto-Renewal. Subscriptions auto-renew monthly until you cancel. You will receive a pre-renewal reminder email 3 days before each renewal. 6.4 Cancellation. You may cancel your subscription at any time through Account Settings → Billing. Cancellation prevents future billing and access continues until the end of the current billing period. 6.5 Right to Withdraw. Under Article 17 of the E-Commerce Act, you may withdraw your payment within 7 days of payment. To withdraw, email support@app.jobenable.com with the subject "Refund Request". 6.6 Digital Content Withdrawal Limitation. Under Article 17(2) of the E-Commerce Act, the right to withdraw may be limited once digital content (such as AI image analysis, style transfer, or enhancement) has been provided. If you have already used these features, refunds may be limited. 6.7 Refund Procedure. To request a refund, email support@app.jobenable.com with the subject "Refund Request" and include your account email, plan name, and reason for refund. We will process refunds within 3 business days per Article 18(2) of the E-Commerce Act. 6.8 Refund Method. Refunds are processed to the original payment method. If the original payment method is unavailable, we will contact you to arrange an alternative. 6.9 Refund Amount. Full refund: within 7 days of payment and the Service has not been used. Partial refund: after 7 days or if the Service has been used, a pro-rata refund for the unused portion of the billing period.

7. Service Availability

The Service is provided on a best-effort basis. We do not guarantee uninterrupted, error-free, or continuous access. The Service may be temporarily unavailable due to scheduled maintenance, software updates, infrastructure upgrades, or emergency situations. We will make reasonable efforts to notify users of scheduled maintenance in advance.

8. User Responsibility

You agree not to: (a) copy, redistribute, or commercially exploit Service content without authorization; (b) use automated means to extract data beyond documented API limits; (c) attempt to reverse-engineer, decompile, or derive the Service's underlying algorithms; (d) interfere with security controls or access restrictions; (e) share account credentials with third parties; (f) use the Service in violation of any applicable laws.

9. Intellectual Property

10. Prohibited Content

You agree not to upload, post, or generate the following content on the Service: (a) obscene or harmful to minors content; (b) defamatory, insulting, or harassing content targeting others; (c) content promoting hate, discrimination, or violence; (d) child sexual abuse material (CSAM); (e) unauthorized use of others' photos, likenesses, or voices, or deepfake-manipulated content; (f) content infringing others' copyright, trademark, patent, or other intellectual property rights; (g) illegal content violating Republic of Korea law; (h) spam, advertising, or content unrelated to the Service. We may remove violating content without prior notice and suspend or terminate accounts of violators. Users can report any community content (posts, comments, reviews, events, profiles), and reported content will be reviewed and acted upon by administrators.

11. AI-Generated Content Policy

11.1 Purpose. The AI Inspiration Workspace feature is a tool for artists to derive new creative inspiration based on their own artwork. AI-generated images are for personal inspiration purposes only, not for commercial use. 11.2 Ownership of AI Content. Users own the AI-generated images they create, but must comply with the license terms of the underlying generative models used. 11.3 Prohibited AI Generation. The following AI generation activities are prohibited: (a) generating images using others' likenesses without authorization; (b) creating deepfakes impersonating real persons; (c) generating images for disinformation or defamation; (d) generating obscene, violent, or hateful content; (e) generating images that unauthorizedly copy or imitate others' copyrighted works. 11.4 AI Labeling. All AI-generated images produced through the Service are labeled as 'AI-generated.' Users are informed that AI-generated images are inspiration tools, not finished artworks. 11.5 Responsibility. Users bear all legal responsibility arising from their use of AI-generated content.

12. Copyright Infringement Report (DMCA)

12.1 Report Process. If content that infringes another's copyright is posted on the Service, the copyright holder or their agent may submit a written report via email (support@app.jobenable.com) specifying the infringing content's location, copyright information, and facts of infringement. 12.2 Action. We will review the reported content within a reasonable period and, if infringement is confirmed, remove or block access to the content. 12.3 Counter-Notice. Users whose content has been removed may submit a written counter-notice via email stating that their content does not infringe copyright. 14. Amendment of Terms

We may modify these Terms at any time. The most current version will always be available on this page. Material changes will be notified at least 7 days in advance. Continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

15. Termination

We may suspend or terminate your access to the Service for violation of these Terms or for harmful or unlawful conduct. Upon termination, provisions that by their nature should survive termination (including Sections 3, 9, 10, and 13) shall remain in effect.
